Traditionally, a lawyer could practice and was presumed competent to practice in any area except patents upon licensure. That viewpoint has taken a hit in the increasingly specialized world at large and of lawyers and attorneys. Truthfully, I think specialization has gone overboard and also there are ethical issues implicit in saying you specialize that quite frankly make it reckless to say you specialize unless you hold a specialization certificate.

When a lawyer takes a case outside their normal practice areas the downside is time. There is a substantial upside in freshness. I’d much rather have a lawyer take a longshot case that’s different from what they normally handle, just to make sure every avenue is followed.

That being said here are some practice areas I don’t handle often as a Memphis Lawyer or don’t come up a lot.

Appellate Law – I really don’t consider this a separate practice area, but every lawyer should be aware of appellate options and use them. Far too few people appeal in Tennessee and I think people should realize appealing questionable rulings is a civic virtue. I’ll usually negotiate a very good flat fee for appeals for that reason if I think they are sound and have the space on the calendar.

Probate - The old dark and dank basement law of the dead. I’m not currently practicing in Probate. If you call I can give several good referrals.

Debt Collection- A subsection of small business.

Criminal Law - When you’ve been arrested, it’s important to hire a Memphis Lawyer to ensure you get a good plea bargain. I’ve stopped doing criminal work because of the factory process of plea bargaining. Click on the link for my philosophy. If you need a jury trial I might consider it.

Tax - I don’t do tax. There is actually a substantial dearth of Memphis Tax Lawyers. I tried to find one for international tax and couldn’t.

Anything, involving large sums of recoverable money. Like I keep stating I’m open and honest about this being a business though being a Memphis attorney is a lot of fun.
